Essure Implant Lawsuit Signed Cases
About a million of Bayer’s birth control device, Essure, have been sold worldwide since 2002. There are tens of thousands of lawsuits pending in the US by women claiming to have been injured by the device. The company stopped selling Essure in the US at the end of 2018. The allegations also include the device failed to prevent unwanted pregnancies, caused stillbirths, led to nickel allergies and depression. Legal claims include that Bayer knew of the risks associated with Essure but failed to warn sellers, doctors and regulators.
Bayer blamed declining sales on an overall decrease of use of permanent contraception, a growing reliance on other birth control methods and “inaccurate and misleading publicity about the device.” Most Essure sales were in the US and there’s been an average 40% annual decline since sales began.
FDA action and warnings
The Food and Drug Administration (FDA) stated some women were not being properly informed of the risks associated with using Essure before getting them surgically implanted so it limited its sale to facilities providing full information about its risks and benefits in April 2018.
The FDA placed its strongest safety warning label on the device after thousands of complaints. The agency asked Bayer to conduct a post-market study. The agency said it received nearly 12,000 Essure complaints in 2017. Bayer claims its extensive research as well as independent medical research showed Essure was safe.
Chronic bleeding, crippling pain and unhelpful doctors
In an article about issues Canadian women had with the device, and the government’s response, the CBC told the story of 39-year-old Trisha Travis. She and her husband decided that, after having two sons, their family was complete. She assumed she would have a tubal ligation procedure but her physician told her about Essure, a birth control device that would be implanted for life.
She had them inserted in a non-surgical, non-invasive procedure in October 2014. Days later her health started to decline. It was the beginning of a two year medical odyssey of physical and emotional pain, with problems including relentless backaches, cramping, rashes and constant bleeding. Travis stated her pain was so severe it would cause her to sweat and shake.
While working at a nursing home, a blood clot the size of a baseball fell onto the dining room floor. She subsequently saw a number of doctors, some of whom said it was normal. Her bleeding continued and a procedure to try to stop it didn’t work. After physicians realized the bleeding wasn’t menstrual in 2015, she had an emergency hysterectomy, which ended her problems.
Travis’ uterus had been punctured during the Essure implant, causing the bleeding. She states her doctor never told her about the puncture.
Another woman, Keri Ponace, 40, had Essure implanted in 2012 and started feeling pain six months later. The mother of five stated the pain was so severe she spent her time on her couch or in fetal position on her bed. She returned to her doctor, who told her she was imagining the pain because the coils were still in place.
In 2016 Ponace learned about what other women were going through via social media. She convinced her doctor to remove her tubes containing the coils, but that didn’t relieve the pain. Later an x-ray showed a one millimeter metal particle from Essure lodged in her uterus. At the time of the article, she was waiting to have a hysterectomy done. She described her pain as feeling like she’s being sliced up inside when she sits down, stands up or moves around.
An Illinois doctor, Dr. Brett Cassidy, who has inserted Essure in the past now removes them. He found the coils to be very fragile and while trying to remove the implant’s small metal fragments would come off. Hysterectomies are becoming the treatment for Essure problems. Women may not be happy to have the procedure but they want the pain and medical problems to end.
